Welcome to ARKNAI ("we," "our," or "us"). By accessing, browsing, or using our website and platform (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not access or use the Service.

ARKNAI is an freee AI chatbot and agent platform purpose-built for minority communities, supporting trilingual interaction in Uyghur, Chinese, and English. These terms govern your use of the ARKNAI website, platform, and any related services.

2. Description of Service

ARKNAI provides an AI-powered chatbot and agent platform that enables users to:

  • Interact with AI models from over 50 LLM providers through a unified interface.
  • Create, configure, and run AI agents using the Agent Loop Engine.
  • Manage skills, memory, and web search capabilities.
  • Communicate in Uyghur, Chinese, and English with full language support.
  • Access the platform across devices including macOS, Windows, iOS, Android, and Web.

The ARKNAI platform is free and free under the Free License. Users are responsible for their own API keys and associated costs from LLM providers.

3. User Responsibilities

As a user of ARKNAI, you agree to:

  • Compliance with Laws: Use the Service in compliance with all applicable local, national, and international laws and regulations.
  • API Key Security: Maintain the confidentiality of your API keys and account credentials. You are responsible for all activity conducted through your API keys.
  • Acceptable Use: Not use the Service for any unlawful purpose, to distribute malware, to engage in harassment, or to infringe upon the rights of others.
  • Content Responsibility: You are solely responsible for the content of your conversations, agent configurations, and any data you process through the platform.
  • No Abuse: Not attempt to disrupt, damage, or gain unauthorized access to the Service or its underlying infrastructure.

4. Intellectual Property

The ARKNAI platform is released under the Free License. This means:

  • You are free to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the software.
  • The software is provided "as is," without warranty of any kind, express or implied.
  • A copy of the Free License is included in the project repository.

The ARKNAI name, logo, and brand assets are our trademarks and may not be used without our permission. User-created content, skills, and agent configurations remain the intellectual property of their creators.

5. User Content and Data

  • Ownership: You retain full ownership of your chat conversations, agent configurations, skills, and any other content you create using ARKNAI.
  • Local Storage: Your data is stored locally on your device. We do not have access to your conversations or configurations.
  • No Data Mining: We do not mine, analyze, or use your content for training AI models.
  • LLM Provider Processing: When you use ARKNAI with configured API keys, your prompts are processed by the respective LLM providers according to their terms and privacy policies.

6. Third-Party Services

ARKNAI integrates with over 50 third-party LLM providers. We are not responsible for:

  • The availability, accuracy, or reliability of any third-party AI model.
  • Any costs incurred through the use of third-party API services.
  • The data handling practices of third-party providers.

Your use of third-party LLM providers through ARKNAI is subject to their respective terms of service and privacy policies.

7. Limitation of Liability

To the fullest extent permitted by applicable law:

  • ARKNAI is provided "as is" and "as available" without warranties of any kind, either express or implied.
  • We shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use or inability to use the Service.
  • We are not responsible for any content generated by AI models accessed through our platform. AI-generated content may contain inaccuracies and should be reviewed before use.
  • In no event shall our total liability exceed the amount you have paid us (if any) in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless ARKNAI, its contributors, and affiliates from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, or the ARKNAI project.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws. Any disputes arising under these Terms shall be resolved through informal negotiation first. If a dispute cannot be resolved, it shall be submitted to binding arbitration in accordance with the rules of a mutually agreed arbitration service.

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

12. Open Source Contributions

ARKNAI welcomes community contributions. By submitting contributions to the ARKNAI project, you agree that your contributions are made under the Free License and that you have the right to grant such license. All contributions are subject to review and acceptance by the project maintainers.
